Terms of service

These Terms of Service govern purchases from Lumera and use of our website. By placing an order, approving a custom design, or purchasing a Lumera product, you agree to the terms applicable to your order.

Made-to-Order Products

Lumera products are made to order and may be fabricated according to customer-selected dimensions, colors, configurations, materials, and other specifications.

Once an order has been approved and released for production, changes, cancellations, and returns may be limited as described in our Returns & Cancellations Policy.

Customer Approvals & Specifications

Customers are responsible for reviewing all dimensions, drawings, selections, configurations, and other specifications submitted for approval.

Once approved, those specifications become the basis for fabrication.

Lumera is responsible for fabricating products according to the approved order specifications. Lumera is not responsible for errors resulting from inaccurate measurements, dimensions, drawings, specifications, or other information supplied or approved by the customer, contractor, designer, installer, or other third party.

If Lumera identifies information that appears incomplete or inconsistent, we may pause production until clarification or approval is received.

Measurements & Site Conditions

Unless Lumera has specifically contracted to perform field measurement or templating, the customer is responsible for the accuracy of measurements provided to Lumera.

Customers are also responsible for verifying that the finished product is appropriate for the intended location, including cabinetry, walls, plumbing, structural support, access, clearances, and other site conditions.

Materials & Appearance

Colors, patterns, textures, veining, particulate distribution, sheen, and other visual characteristics may vary between samples, photographs, digital displays, material batches, and finished products.

Reasonable material and fabrication variations that do not materially affect the intended function of the product are not considered defects.

Pricing & Payment

Prices are subject to the terms presented at checkout, in a proposal, or in another written order document.

Orders may require full or partial payment before materials are ordered or fabrication begins. Lumera may suspend production or shipment when required payments, approvals, or project information have not been received.

Applicable taxes, shipping, freight, delivery, installation, or other charges may be added where applicable.

Changes After Approval

Changes requested after an order has been approved may require revised pricing and additional production time.

If fabrication or material procurement has already begun, some changes may not be possible.

Any additional costs resulting from an approved change are the customer's responsibility.

Shipping & Delivery

Shipping, freight, delivery, inspection requirements, and transportation-related claims are governed by our Shipping & Delivery Policy.

Customers are responsible for providing accurate delivery information and promptly inspecting delivered products.

Installation

Installation is not included unless expressly identified in the applicable order.

When installation is performed by the customer or a third party, the customer is responsible for ensuring that the installer is qualified and that the product is properly handled, supported, and installed.

Products should be inspected and verified against the approved specifications before installation, cutting, drilling, modification, or other permanent work begins.

Returns & Cancellations

Returns, cancellations, and refunds are governed by our Returns & Cancellations Policy.

Made-to-order and custom products are generally final sale once released for production, subject to the rights and remedies provided by applicable law.

Warranty

Lumera products are covered by our applicable Limited Warranty.

Warranty coverage does not extend to damage resulting from improper installation, misuse, modification, improper maintenance, incorrect customer-provided information, or other exclusions described in the warranty.

Intellectual Property

Lumera's website, product designs, photographs, drawings, renderings, graphics, branding, written content, and other original materials are owned by or licensed to Lumera and are protected by applicable intellectual-property laws.

No purchase grants the customer a right to reproduce, manufacture, commercially exploit, or distribute Lumera's proprietary designs or materials except as expressly authorized in writing.

Limitation of Liability

To the fullest extent permitted by applicable law, Lumera will not be liable for indirect, incidental, special, consequential, or punitive damages arising from a product, order, delivery, installation, or use of the website.

To the fullest extent permitted by applicable law, Lumera's aggregate liability arising from a particular order will not exceed the amount actually paid to Lumera for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Website Information

We make reasonable efforts to ensure that product descriptions, photographs, pricing, dimensions, and other website information are accurate. However, typographical errors, technical inaccuracies, or omissions may occasionally occur.

Lumera may correct such errors and update website information as permitted by applicable law.

Privacy

Use of personal information submitted through the website is governed by our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Changes to These Terms

Lumera may update these Terms from time to time. The terms applicable to an order will be those in effect when the order is placed or otherwise agreed to in writing.
